

So what is Cameron up to, well a number of things and they are all opportunist to the core and pretty unsavory to boot; and not one is in the public interest. Firstly, no matter what ever way you look at it, Cameron and Osborne are demanding that Conservative MPs have legal rights over and above their fellow citizens. If a member of the public takes possession of a stolen document, either physically or via the Internet, she/he is receiving stolen property, if he/she encouraged the thief to steal it they are part of a criminal conspiracy. Now they may well claim a public interest defense and hope for the jury to show good sense, but under current law, into the dock they go, as wrong as I may believe this to be.
As Damien Green has not denied the aforementioned we must conclude this is what he has been engaged in here; and it looks like plod has him bang to rights as it is difficult to believe the police would have gone to these lengths without firm evidence. Could the leaker have touted on Green for a lesser sentence? we know Green had some sort of relationship with him as the man allegedly applied for a job in the MP’s office.
David Cameron and his friends in the media clearly hope with all their huffing and puffing to put plod off the scent or get the government to pressurize the police to pull the investigation; or place it at the bottom of a very large pile. Some of the comments that have come from David Cameron and shadow Ministers of late, highlight just how far out of touch they are with ordinary life in the UK.
It is nonsense to claim that it is an unusual occurrence for the police to arrest, search and detain a citizen who is presumed to have committed an offense, it goes on in the UK every day of the week; as to the manner of Green’s arrest being worthy of the Stasi or the Stalinist secret police, it is a direct insult to the millions who were actually arrested by these thugs.
Such talk about police mistreatment would be laughable to most working class people, especially those who are black or members of the islamic faith and who regularly feel the sharp edge of the British police. Members of the underclass would be in hysterics as such things occur within their communities with depressing regularity. Not for a potential major crime like conspiracy to rob, but for trivial offenses or fishing expeditions.
As a shadow government minister there was absolutely no reason why Green should need to act in a covert way when seeking government documents, once he was aware of their existence he could simply have asked the relevant minister to provide him with a copy. That he failed to set up a cut off, yet again displays the incompetence of Shadow cabinet members.
Unless that is he was simply playing politics in the same manner as George Osborne was when he too came unstuck recently; and Green’s intention was to pass covertly a copy of the said document to a friendly journalist in the hope of discrediting the government. If so it tells us a great deal about how David Cameron runs his kitchen cabinet, Mandelsonese springs to mind.

Damien Green wasn't arrested on suspicion of theft or of handling stolen goods - such charges wouldn't be applicable unless he had the actual files belonging to the Home Office. They were investigating him for aiding or abetting misconduct in a public office which carries a maximum sentence of life. A journalist on similar charges was recently acquited partly on the grounds that under human rights legislation she was allowed to freely pass and receive information.
Apart from calls for MPs to have immunity from arrest by the police (which exists for members of many European parliaments) I can't see that the Tories are calling for any special treatment for Damien Green. The actions of the police attack all of our civil liberties so as distasteful as it may be we should defend this Tory in this instance.

I think the aiding and abetting misconduct in public like charge that was on the arrest warrant, was the means the police used to search his properties.
Myself I am totally against given MPs immunity, in countries where this is in force you have all sorts of crooks becoming MPs to gain immunity, Turkey is an example and I believe Italy too. There are enough crooks in parliament without making it official.
I am not sure how the arrest of Green attacks ordinary peoples civil liberties, perhaps someone could explain it to me. As someone pointed out on the LLB list much of the info he gained was used in a political manner to discredit his political opponents and did not benefit the public one iota as far as I can judge.
I also feel it is a matter of public interest whether an MP used any enticements to corrupt a junior civil servant . If he is innocent of these things, good luck to him, but I cannot for the life of me see why he should get special treatment when those MPs who have previously been arrested did not.
Well Turkey and particularly Italy have recent histories of politicians being imprisoned by their political rivals - followed by supression of all dissent and mass murder.
I say it is an attack on all our civil liberties because if an MP can be arrested for this then so can political activists like you and me.
government should not have secrets from its people. I am as sure as you that Damien Green would have used any information he got for party political ends but he does not deserve to go to prison - at leas not for that!

But surly we have always been vulnerable to arrest for such offenses, as you said a journalist was recently arrested for such an offense and fortunately acquitted. What I fail to see is what makes Green special and why he should get preferential treatment.
Cameron's main gripe now seems to be because Green has an office in the Palace of Westminster and it should not have been turned over and then the immunity thing follows through.
Although I agree that governments should not have secrets from its people, now if this incident could be used to build a campaign against the secret state, that would be something, but we both know the Tories revel in state secrecy as much as Labour.
99% of 'state secrets' could be made public tomorrow and no one would be the worse for it. But for that to happen we would need a political revolution, we can but hope I suppose;)

I'm not calling for special treatment - I think we should defend all people from arrest on such charges. you are the one that seems to be giving him special treatment because he is an MP! I know it is hard to have sympathy for a Tory but if he were to be convicted of this it would be a precedent that the police could use to harrass all sorts of campaigners that rely on sources in government.

I realize you are not calling for special treatment for Green and I understand your argument but I am not convinced although I will give it some thought and I agree it is a traditional left argument.
I just do not see it is relevant here, not least because there is not a hope in hell of Green being sent to jail. Not least because when the huffing and puffing dies down and Cameron has rung all the political capital he can out of Greens arrest, he will shunt this matter into the appropriate siding.
I just do not see it as the lefts role to assist him in doing this and just to be clear I am not saying that is what you are doing Phil.
